They can't tell whether focus order makes sense, whether a screen reader announces your custom dropdown correctly, or whether error messages actually help someone recover. In practice they are the same work. The ADA itself does not publish technical standards for websites, so US courts and settlements have consistently pointed at WCAG 2.1 AA as the measure. An ADA compliance audit is a WCAG audit with the legal framing attached. If you are responding to a demand letter, ask for the WCAG criteria and severity in writing, because that is what your lawyer and the plaintiff's expert will both work from.
